All NFT transactions facilitated through krakl.ink are executed and recorded on a public blockchain (the "Protocol").
- Irreversible: All transactions are final, non-custodial, and cannot be reversed, undone, or restored.
- You assume full responsibility for ensuring your wallet addresses, balances, and transactions are accurate before confirming any transaction.
3. No Refunds or Guarantees
All purchases made through krakl.ink are non-refundable and provided "as-is."
- No Value Representation: NFTs purchased on this platform do not represent any claim to equity, utility, revenue, services, or any tangible or intangible value.
- Speculative Risk: NFTs are inherently speculative and volatile. You accept all risk related to ownership and transfer.
4. Disclaimers and Limitation of Liability
- NO WARRANTIES: We provide the Site and related services "as-is" and "as-available" without any warranties or guarantees of any kind.
- NO UPTIME GUARANTEE: Access to the Site may be interrupted, suspended, or terminated at any time for any reason, including without limitation for maintenance, upgrades, or technical issues.
- NO RESPONSIBILITY FOR BUGS OR HACKS: We shall not be liable for any loss or damage resulting from smart contract bugs, exploits, hacks, downtime, wallet loss, or any other failure related to on-chain interaction or digital assets.
- MAXIMUM LIABILITY: In no event shall our total liability exceed $100 USD, regardless of the cause of action.
5. Intellectual Property
Unless otherwise stated, all content on krakl.ink (excluding user-owned NFTs) including text, images, graphics, code, and branding, is our intellectual property or used under license. You may not copy, reproduce, or distribute any part of the Site without prior written permission.
6. Third-Party Services
We are not responsible for the functionality, accuracy, or availability of third-party tools, wallets, blockchains, or marketplaces used in conjunction with our Site. Use them at your own risk.
7. Indemnification
You agree to indemnify, defend, and hold harmless krakl.ink, its creators, affiliates, partners, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your NFTs, or violation of these Terms.
8. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the jurisdiction of the primary operator's domicile, without regard to conflict of laws principles. You consent to the exclusive jurisdiction of competent courts in that jurisdiction.
9. Dispute Resolution
All disputes arising out of or related to these Terms or the use of the Site will be resolved by binding individual arbitration, unless such arbitration is prohibited by local law. You agree to waive any right to class actions or jury trials.
10. Changes to Terms
We may modify these Terms at any time. Continued use of the Site following updates constitutes your acceptance of the revised Terms.
